We thought it was time to post a page that explains some of the legal ramifications when entering into a contract with VPS. So, as a benefit to our future clients, we want to be clear what those legal rights are on our services and copyright laws.

  1. VPS shares the “intellectual rights” of our digital images we take of you. Either still or film, we want you to have the same rights as we do. This means that we offer at no additional charge, Raw Photos and Raw Video. You may use the raw files to edit them or create something new if you desire, however if you hire a content creator, or have “uncle joe” edit them for you, and should he damage them beyond repair, you may have lost your wedding pics and films forever. In addition, if you hire a content creator who claims attribution to the content, and then publishes it, you and that creator have violated a copyright law. Always contact us first and either get permission in writing, or phone us to discuss the proper procedures. Failure to do so can result in litigation in a court of law, and we really dont want that at all.
  2. Revisions ; Our photos are edited and color graded in stages. You will receive a sneak peek of your photos or video. In most cases, they may be published directly to your facebook page if you request it, or you failed to communicate how you wanted them delivered. We strongly suggest that you look at them on our Private Gallery, where only you and us can see them. Sometimes, if requested or suggested, a shared link for family members is included. Many people like to share their photos and pics with family members and get their opinion. If the images or the film is shared publicly, before the color grading and editing is finished, you agree to not hold VPS liable for any damages as a result from dissatisfaction, transfer of the image using the internet, thumb or ssd drives. In other words, if you receive negative feedback from the photos prior to them being finished, it places our company in a bad light, and could damage our business model. Therefore, do not publish anything until your perfectly happy with it. Should you hire or use a content creator other than VPS with raw photos, you void our agreement and contract, and VPS is not liable for any damages physical, emotional or financial from the result of violating the agreement.
  3. Dissatisfaction of photos or film delivered: VPS recognizes that your wedding day is truly a special time. This is why we make every effort to be prompt, instruct you for poses, or direct you during our filming process. We offer traditional, Romantic and Documentary styles. Examples of those types of work are readily available on our youtube channel and website. There is NO guarantee that your video or pics will look like the examples we have of other clients work. Some clients pay additional charges for styles, have props, or get married in multi million dollar venues. Your film and pics will be surrounded by your choice of venue, decorations, style of clothing and dress, willingness to participate in planned direction discussed ahead of time during scheduled zoom meetings. If you fail to communicate your desires or wants, and expect your pics or film to look like clients who have made those claims necessary, you will be sadly dissatisfied with no recourse whatsoever for neglecting to communicate those desires. You then therefore agree to not hold VPS liable for your neglect and dissatisfaction.
  4. Zoom Meetings: Zoom meetings are conducted on a as needed basis. Typically, they are scheduled with your available schedule, and in most cases we can accommodate after work time frames. It also goes without saying it, but we will for those who may not understand….YOU are responsible for the schedule of your zoom meetings, to discuss your desires with us. DM us through Facebook with a time frame you can meet, and someone will be with you on that exact time, and even extend the meeting if necessary. If you neglect to discuss your desires of how your pics and video should look, or provide a coordinator who may also fail to communicate in detail how you want your pics and film to look, then we will choose a style at our discretion, and it may or may not be to your satisfaction. In either case, you agree to not hold VPS liable for any dissatisfaction that arises from your neglect.
  5. Liability: Expressed or given, you agree to not hold VPS liable for damages incurred to your wedding venue, guests, or family members, Bride or Groom by accident, electronic, or other means that would constitute liability. VPS does however carry liability insurance required by a venue.
  6. Software distortions and Lighting : From time to time, VPS receives and tests reliable software for editing purposes. Our main source of editing software used is Adobe Lightroom, and Skylum NEO, which is a plugin for Adobe Lightroom. In rare occasions, a photo may be distorted or may not have turned out the way it was shot through this software and is then inadvertently delivered as a sneak peek. DON’T PANIC..the original photos are still preserved and a correction will be made of the pic that may have been distorted. It’s common in photography or videography to have glitches especially when a software update has occurred. VPS makes every attempt to correct the distortion with the original image and in all cases delivers a pic that is clean and crisp from distortion. Lighting is also another issue that can plague your photos. Lenses react to different types of lighting, and in most cases can be corrected in post editing. We use natural lighting, LED lighting, on and off flash lighting. However, during our first stages of sneak peeks that are private for just your viewing and or family, lighting can be an issue. VPS can and will attempt to correct the lighting issue in house and with editing software. However, no guarantee is made that the lighting for the pic at the time of the shoot is the ideal lighting or that the software can correct the issue.
  7. Digitally signed contracts: At the time of booking, VPS will send you a contract/agreement that must be signed and returned. Don’t neglect to return our copy of the signed contract. We keep a digital copy on hand for our records. It is your responsibility to sign the agreement/contract and return it to us via email prior to your wedding date or photoshoot. Doing this protects both of our interests and makes for a solid and agreeable platform before we even get started.
